The edition critique and the evaluation of the chapter Usulü'l Fiqh in Gaznawi's El-Hawi'l Qudsi

An important part of the works called as classıcal works is in the form of manuscripts. One of the basic conditions to produce new knowledge is to up-date the manuscripts written in the science based traditional frame at the past. So studying the manuscripts is so crucial for producing strong and continual scientific works in the future along with carrying out the responsibility belonging to the past. Our thesis is about the chapter usulu?l fıqh of Havi?l Qudsi which is in a sense the summary of Debusi?s Taqwimu?l Edille, having an important place in Islamic law. This work has a modest contribution for coming the manuscripts to light. The subject, aim, method and researches of this thesis has been given at the introduction. The book if belongs to the author was studied and the knowledges in the available copies of the book and the biographical sources were compared, also the information about the available copies of Hawi?l Qudsi has been studied at the first chapter of our thesis. The edition critique of the chapter `usulu?l fiqh? in Hawi?l Qudsi has been at the second chapter of our thesis. At the third part, the topics studied are the author?s method to consider the issues, the systematic of the work, explanation of the concepts based on Usulu?l Fiqh and Legal (Shar?i) proofs and also, the ideas of the author has been compared with Debusi?s, Sarahsi?s and Pazdawi?s ideasand the book?s position in the hanafi sect has been studied at this chapter. When we prepare the edition critique text, a method has been determined by taking other edition critique works into consideration. The copies has been shown to the library in which they are, within arabic letter, and also differences among the copies has been shown at footnotes. The places of the verses and the hadiths in the text has been determined and the verses within the text, the hadiths? sources at the footnotes have been shown in our study.
