Spiritual counseling within the framework of Maqaid al-Sharia

This thesis provides an in-depth examination of spiritual counseling within the framework of Maqasid al-Sharia, exploring the role and application areas of spiritual counseling under the fundamental objectives of Islamic law. The study thoroughly analyses the spiritual dimensions of Islamic law, particularly the concept of Maqasid al-Sharia (the fundamental objectives of Sharia). In this context, the concepts of rights, the Darurat al-Hamsa (basic necessities), and their relation to spiritual counseling are examined from a broad perspective. Examples are provided of how the elements of spiritual counseling in the Qur'an and Sunnah are applied both theoretically and practically, elaborating on the thematic topics that form the foundation of spiritual counseling. The second section of the thesis, which evaluates the various application areas and approaches of spiritual counseling from the perspective of Maqasid al Sharia, focuses on the practical applicability of spiritual counseling within Islamic family law, criminal law, and psycho-social problems. This section delves into the fiqh rulings related to family structure, the culture of narration concerning marriage and inheritance, and the spiritual counseling needs of social groups such as individuals with disabilities, migrants, and earthquake survivors. Additionally, the appendix of the thesis includes comprehensive recommendations on legal and regulatory frameworks, as well as educational and certification standards. This appendix analyses the current legal status of spiritual counseling in Turkey, legal regulations, and strategies for creating social awareness. Detailed recommendations are provided regarding the professional definition, working environment, skill standards, and professional development in the field of spiritual counseling. In conclusion, the thesis aims to contribute to addressing existing gaps from the perspective of Islamic law by offering important psycho-theological insights and recommendations for effective and comprehensive spiritual counseling practices, particularly improving understanding and effectiveness in spiritual counseling applications in Turkey.
