Individual application road for violation of reasonable treatment

The right to a fair trial is an essential element of Article 6. 1 which guarantees the right to a fair trial of the European Convention on Human Rights. This principle grants persons the right to demand that their proceedings be carried out within a reasonable time. Although many of the applications and decisions made to the European Court of Human Rights against our country in recent years have been related to this principle, the unlawful decisions made are negative for our country. This disadvantages are reduced to minimum and the right of individual application to the Constitutional Court has been influenced by the alleged infringement of persons, which was accepted by the 2010 Constitutional Amendment. The objective of our work titled '' Individual Application Road for Violation of Reasonable Treatment ''; to set forth the criteria set by the European Court of Human Rights on the right to a fair trial and to establish on what fundamental rights and freedoms the Individual Application Mechanism has been adopted since 2010 in the event of a violation, The concept of time is very important for every individual, and the fact that compensation for waste of time is not possible in any way clearly reveals the importance of reasonable time in the judicial proceedings. Therefore, we have also briefly addressed the precautions that could be taken for our country regarding the fact that the reasonable wage in our work is assessed separately for each case and event, the determination of the wage must be determined meticulously and the wage should not be exceeded.
