Abstract (EN)
In this study, in order to evaluate the influence of the domain names to the trademark law and the conflicts between the Internet domain names and the trademarks, it was necessary, primarily, to analyze the legal nature of the domain name in Internet and the nomination system and then to examine the different types of the possible conflicts between the domain names and the trademarks in order to find alternative ways of their resolution.Although, domain names technically function like a telephone number, which helps the Internet users to access to the desired web site, due to the increasing volume of e-commerce and e-advertisements, as the companies consistently try to use their trademarks and trade names to access their web sites, domain names have acquired a secondary meaning and have acquired the nature of business identifiers.This has resulted in on the one hand, the cybersquatting activities, through which, the cybersquatters grab domain names which are identical to or confusingly similar to the other business identifiers of third parties by acting more quickly than the owners of rights. On the other hand, this has also resulted in registry of famous domain names as a mark by tierces. So we need to find a solution to protection of domain names owners.
