Abstract (EN)
In Turkish trademark law, with the enactment of the Industrial Property Code, the "letter of consent" came into force and creating an exception to the principle of uniqueness. This article allows the parties to a coexistence agreement to use identical or indistinguishably similar trademarks by registering them with TURKPATENT. Additionally, parties to a coexistence agreement can use the identical or indistinguishably similar trademarks without a letter of consent under Turkish law. Within this scope, this study aims to determine the legal characteristic of the coexistence agreement, the rights and obligations of parties and legal consequences of the termination of this agreement.
