Comparison of TPI and judgement decisions on the resemblances of trademarks

In this post graduate thesis, the issue of trademarks resemblances ( no 556 decree law) are tried to be explained by comparing TPI decisions and judgement decisions. In the first part of the study, general information with regard to the trademark is included. In the second part the resemblance of the trademark is discussed by comparing TPI decisions and judgement decisions, in the third part the decisions that TPI and judgement organs have made are criticised by making a general evaluation, TPI's and judgement organs' positive and negative aspects are evaluatiated and the things that can be done on the issue of improving the failing aspects are included. In the first part of the study information with regard to the trademark is included besides, some information based on no 6769 law is also included. However in the second and third part of the study the issue is discussed by attributing to the clauses of no 556 decree law. It is bacause of the fact that no 6769 law was accepted in the Turkey Grand National Assembly on 22/12/2016 and it entered in the force on 10/01/2017 being published on the official gazette yet, the decisions of TPI and the judgement belonged to 2017's before and it attributed to the decree law. The clauses of no 566 decree law are attributed in line with the decisions of TPI and the judgement decisions in order not to give rise to any confusion during the expression of the issue. Our investigation issue which is a topic on the resemblance of the trademark is arranged in the decree law's subclause of 7/1-b and it is arranged in the no 6769 law's 5/1-ç subclause. The arrangement that is included in no 556 decree law has also taken place in the law without any alteration.
