The institution of vizierate in the context of the works of Mâverdî and Abû Ya'lâ al-Farra on the laws of the Sultanate

This study deals with the vizierate, one of the fundamentalin stitutions of Islamic political thought, from conceptualand historical perspective sand examines how this institution is positioned in the literature of al-Ahkâm al-Sultâniyya. The focus of the study is to evaluate the vizierate understanding of two important authors of this literature, Abû al-Hasan al-Mâwardî (d. 450/1058) and AbûYa'lâ al-Farrâ (d. 458/1066), from a comparative perspective. In the first chapter, the dictionary and terminological meanings of the concept of viziership, the discussions on it setymological origin, and its uses in the Qur'an and had it hsareanalyzed. Then, the institutional transformation of the vizierate in Islamic states from the Asr al-Sa'âdat to the Ottoman period is presented. In addition, the place of alAhkâm al-Sultâniyya in Islamic political theoryand the theoretical foundations of the vizierate institution in these work sareevaluated. In the second part, al-Mâwardî and Abû Ya'lâ al-Farrâ's views on the office of vizier in al-Ahkâm al-Sultâniyya are discussed in detail. In this context, the distinction between tafwîz and tenfîz viziership, the qualifications sought in the personsto be appointed to these posts, the legal nature of the appointment process, and the limits of the authority of the vizier were discussed. In addition, the similaritie sand differences between the two authors' conceptions of viziership are analyzed comparatively.In this study, classical source sand modern literature were evaluated together, and documentarys canningand comparative analysis methods were used. The find ingsreveal that Mâwardî and Abû Ya'lâ's understanding of viziership wasbasically shaped within the framework of a common political theory, but sectarian and periodical differences led to different approaches at certain points.
