Consumer arbitration committee for resolutions of the consumer disputes in the framework of the Civil Procedure Law

Consumers, the definition by the as J. F. Kennedy noted in his famous declaration in 1962, "all of us", constitutes a community that needs to be protected both internally and nationally against the ever-growing competitive market of the modern world. Hence, in this study, starting from the birth and importance of the consumer rights, the development in the consumer rights and the legal works these are applied today, were included. The scope of Consumer Protection Act no. 6502, which is one of the reflections of these studies to the Turkish Law, and the limits of consumer disputes under this act have been determined. Subsequently, the establisment of the consumer arbitration committee, which is emerging with the consumer protection studies in Turkish law, and the existence of similar institution in other legal systems, is discussed. The legal nature of the committees, which constitute a turning point of the thesis, has been discussed within the framework of all opinions in the doctrine, the importance and necessity of this matter is particularly emphasized. The jurisdiction and venue of the committee, application procedure and members of the committee is examined in individual titles. In the end, the procedure of the consumer arbitration committees have been tried to dealt with under the civil procedure law rules, and the decisions taken by consumer arbitration committes, legal nature of these decisions and the impact, execution of the decisions and the remedies against these decisions included in this thesis.
