Abstract (EN)

Proper execution of court decisions, in addition to its significance in legal protection of the prevailing party, fulfills the functions of ensuring legal security and protection of social peace. Thus, clarification of the judgement aims to remove uncertainties or inconsistencies in the judgement to prevent the reservations that could occur during the execution of the judgement, whilst the correction of the judgement is the institution that aims to correct clerical and calculation error and other obvious mistakes that occur in the judgement. The present thesis basically includes three main sections. In the first section, general characteristics procedures of clarification of the judgement were addressed, in the second section, implementation procedures of clarification of the judgement were addressed, in the third section, definition, objective, subject matter and procedures of correction of the judgement institution was scrutinized. Throughout the thesis, the scope of the execution of clarification and correction of the judgement were attempted to be plotted. Thus, it was aimed to prevent changing the judgement with the excuse of clarification or correction of the judgement. During the design of the study, doctrinaire views were addressed and an attempt was made to broadly include supreme court decisions. Furthermore, German and Swiss judiciary regulations were often utilized.
