View in Civil Procedure Law

In this study, the concept of "jury view" regulated under articles 288 to 292. in evidence ssection of Code of Civil Procedure, Act No. 6100 ("CCP") is handled. Jury view is one of the evidences which is regulated under the law and which serves to reach material facts. In the first section of this study, the jury view concept is handled in general terms; the fact that recourse to jury view is in discretion of the judge is examined, the jury view is specified differently from similar concepts/institutions and legal characteristic of thejuryview is set forth by also dealing with different legal opinions on this matter. In the second part of the study, procedural actions related to jury view and execution of jury view are set out. In the third section of the study, thefact of opposition of the parties to jury view and judge's considering the findings obtained as a result of the jury view as evidence are reviewed.
