Abstract (EN)
In Turkish law, the urban planning authorization is attributed to local authorities in a questionable position because of the abundance of exceptional powers granted to ministries and other institutions. In the present work, the limits of the principles of the Local Administration and the Administrative Tutelage in the article 127 of the constitution which are fundamental in determining the obligations and powers of local authorities are examined in the light of the interpretation of the Constitutional Court and the concept of "common local needs". The criteria that determine the distribution of powers between central government and local authorities are sought and hence the above, which authorities responsible for implementing these activities are explained and when done, compliance hereof powers conferred local authorities, ministries and other administrative units are discussed.
