Protection of the consumers on distance contractcs for intermediaries

Abstract (EN)

The uncontrolled growth of electronic commerce in recent years, has led to new implementations. In this respect, distance contacts will be the subject of thesis. Distance contracts are defined as "Contract between the consumer and the vendors or providers through the simultaneous use of long-distance communication means". According to this definition, we may say the contracted parties are consumer and vendors or providers. Based on this definition, the elements of the contract is determined. The communication tools may change the legal consequences, the establishment and their validity. The disadvantageous legal statute of the consumers on distance contracts, is trying to be obviated with legal regulations. On the other hand, the liability of intermediaries who defined as "online platform providers that are not the party to the contract" is controversial in international doctrine. The regulations on this matter in Turkish law are Law No.6502, Law No. 6563, Law No.6098 and the guidelines for these codes. All those regulations are not limit the liability of intermediaries. Thus, the source of intermediaries' liability has to draw the lines well. Our thesis present distance contracts' theorical line after its' exhibited especially costumers' protection mechanisms and the liability area of intermediaries. Under the light of current legal regulations, our opinions on this subject are presented in this thesis.
