Abstract (EN)
Professional Liability Insurance General Conditions is the first positive regulation on professional liability insurance in the Turkish Law that provides protection against risks emerging from professional activities conducted by professionals. In case of a risk, the insurer is responsible for ensuring protection against compensation claims asserted to insured parties by third persons to the amount agreed upon in the contract. Together with Professional Liability Insurance General Conditions, additional clauses regarding risk in the course of these professions are adopted with respect to attorneys, doctors, independent accountants, certified public accountants and chartered accountants. In our work, the notion of risk in General Conditions and additional clauses are dealt with in the light of views in doctrine and studied within the framework of current and draft Turkish Commercial Code. Furthermore the extent of the protection and damages included within this scope in General conditions and additional clauses are analysed in great detail.
