Land sale contract in Metaverse

While there is no uniform definition of the metaverse, it can generally be described as a virtual universe where physical reality and virtuality converge through various technologies. In the metaverse, individuals can socialize and interact via avatars, free from the constraints of physical laws. A key distinction between the metaverse and the internet lies in their dimensions: the internet is predominantly two-dimensional, whereas the metaverse is three-dimensional and offers a multi-sensory experience. Millions of users engage with metaverse platforms designed for diverse purposes such as gaming, business, entertainment, and tourism, investing in these platforms in various capacities. Metaverse platforms are categorized into real-world and virtual-world metaverses based on whether they utilize real-world maps or fictional counterparts. Some platforms monetize by selling virtual land, which mirrors real-world geography. In real-world metaverse platforms, exact replicas of real-world maps are partitioned into parcels of varying sizes and sold. Notably, these parcels, referred to as "land," are sold irrespective of whether the corresponding real-world property belongs to a private individual or is state-owned. This practice raises concerns about potential legal disputes, particularly of a commercial nature. For instance, conflicts may arise if a business seeks to maintain its brand identity in a specific metaverse location already sold to another party. Beyond legal implications, the sale of culturally significant land, symbols of state or societal importance, and its subsequent use by new owners in ways contrary to national values, pose risks of sociological and political discord. This study examines these risks and challenges through existing cases and sales scenarios, aiming to propose new definitions and concepts for metaverse lands. It underscores the necessity for legal frameworks to adapt to technological advancements and mitigate potential issues stemming from virtual land transactions.
