Abstract (EN)

The number of works on the judgment of fiqh is very large. These are works that regulate almost every aspect of human life. They cover a wide range of issues from praying to fasting, from slave laws to marriage. When we examine these books, we see that the scholars who wrote them followed different methods. Here, while analyzing the chapters on family and criminal law in Mawkūfātī Mehmed Efendi's Mülteqā Translation and Commentary, we tried to examine how the commentator handled these issues. While writing the book, Mawkūfātī sometimes brought the evidence of the text he annotated, either a verse or a hadīth, sometimes gave explanations in the form of an answer to a question, sometimes mentioned a hadīth related to the subject in order to better fit the issue he was trying to explain in the mind, and sometimes mentioned general principles related to the subject. In the first part of our thesis, which consists of three chapters, a brief overview of Mawkūfātī's life, his works, and the tradition of commentary and glossing in the Ottoman Empire was made. In the second part, we compared Mawkūfātī's commentary method with the method of Alā al-Dīn Haskafī in his commentary on al-Multeqā, al-Durr al-Muntekā, and tried to reveal the similarities and differences between them. In the third part, we examined the method of Mawkūfātī's commentary and translation of al-Multeqā in detail.
