An evaluation of Ali Al-Qārī's work which titled as Fath Bāb Al-ʿInāyah according to the intra-madhhab preference methodology

ʿAlī al-Qārī spent most of his life in the Mecca region, where the Ḥanafīs were relatively few in number. In addition to his Ḥanafī teachers, he also studied under scholars from other schools of thought, which helped shape his intellectual interests and his scholarly and jurisprudential personality. He authored his works and continued his academic pursuits. Prominent as a ḥadīth scholar, ʿAlī al-Qārī wrote Fatḥ bāb al-ʿināyah, a commentary that holds an important place among the late-period reference works used in the iftāʾ process and in fiqh studies. He composed this work with the aim of supporting the Ḥanafī school from the perspective of ḥadīth. The aforementioned geographical, social, and intellectual factors had a significant impact on his legal thought and on his explicit and binding preferences, which constitute one type of fiqh activity. Efforts have been made to reveal the dimensions of this influence around the methodology of legal preference and within the framework of Ḥanafī fiqh works. This study also aims to serve as an example by demonstrating the nature of reaching the principal fatwa opinion through the accumulated knowledge and the pool of opinions that have developed over time within the Ḥanafī school. In this context, our study consists of an introduction and two chapters. The introduction addresses the subject, significance, purpose, methodology, and literature review of the study. The first chapter discusses ʿAlī al-Qārī's life, intellectual biography, and works. In addition, the principles and rules of intra-school preference are presented. The second chapter examines the rulings in the Kitāb al-ṭahārah section of ʿAlī al-Qārī's Fatḥ bāb al-ʿināyah. The conclusion summarizes the findings obtained over the course of the study.
