The breach of the contract by the buyer and its effects under the united nations convention on contracts for the international sale of goods (CISG)

"United Nations Convention on Contracts for the International Sale of Goods," referred to as the "Vienna Convention" or abbreviated as "CISG" provides a uniform regime for contracts for the international sale of goods. The Convention was adopted unanimously by 62 States at a diplomatic conference in Vienna on 10 April 1980. As of 8 June 2016, the Convention has 84 state parties that account for the majority of the world trade, including Turkey, which ratified the Convention on 1 August 2011. Turkey, during the ratification process of the CISG, adopted the "Turkish Code of Obligations" on January 1, 2011. The Code entered into force on July 1, 2012. The provisions of the Code regarding the contracts for the sale of goods differ from the provisions of the CISG at many points. The most striking difference is that the Code stipulates a different regime than the CISG regarding non-performance of the obligations. This study addresses the remedies of the seller for the breach of the contract by the buyer under the CISG by comparing related provisions of the "Turkish Code of Obligations."
