Abstract (EN)

The new Private International Law Act has been entered into force in 2007. This new act brings an important innovation, especially on the law applicable to contracts. This innovation has been influenced of the law of European Union, i.e. Rome Convention. The fundamental of this alteration is the article 24. This provision designates the law applicable to contracts both in case of choice of law and of its absence. This researche embraces both aspects in the framework of comparative law; it deals with the actual state of European law on the law applicable to contracts and interregates the pertinence of the new Turkish disposition. Some problems concerning the application of this disposition have also been treated in this thesis.
