Abstract (EN)
This thesis examines the contact with a child in private international law. The first chapter describes the concept of contact concerning children, clarifies the regulations of the concept in Turkish law and international conventions, and examines the applicable law for the disputes of contact with a child with a foreign element. The legal characteristic, scope, and regulation of the contact, how to determine the applicable law and other issues to be considered are discussed. In the second chapter, the international jurisdiction of the courts in disputes regarding contact with the child and the recognition and enforcement of the decisions of foreign courts are emphasized. In this context, the international jurisdiction, recognition, and enforcement regulations in the MÖHUK and international conventions have been examined.
