Abstract (EN)
Due to the fact that parties subject to legal systems with different characteristics come face to face during the dispute resolution phase, arbitration proceedings, and are familiar with different legal systems, there is no clear practice or set of rules, especially in terms of the evaluation of witness evidence. In our study, ethical violations in witness statements will be revealed by examining similar and different regulations in the rules of different legal systems regarding testimony as a means of proof, which is evaluated in both commercial arbitration and investment arbitration within the scope of international arbitration law. In addition, violations of the right to defense encountered in the recognition and enforcement of decisions made within the scope of witness evidence in international arbitration law will be discussed with examples from practice and judicial decisions, and current problems regarding witness evidence in arbitration and suggestions on the use of witness evidence will be evaluated.
