Abstract (EN)
The main purpose of this study is to discuss "International Arbitration Concept and Arbitration Process in Turkey within The Rules of Istanbul Arbitration Center". Arbitration is a technique for the resolution of disputes, arisen between the parties, by a third party instead of the state courts on condition of parties' agreement. Istanbul Arbitration Center (ISTAC) is an independent institution of arbitration, which has been established for the purpose of providing national and international arbitration services. The study consists of three main parts. The first chapter is titled as "Arbitration Concept and Historical Devoplement" and in this chapter, arbitation concept and facts are examined in consideration of supreme court decisions and doctirine views. In continuation, the historical devoplement of arbitration and its properties and advantages, which provides taking an important place in national and international legal orders form past to present, are explained in detail. The second chapter, titled as "Arbitration Process in Turkish Law and Regulations of Arbitration", explains the place and importance of arbitration in Turkish law and details the relation between arbitration and Alternative Dispute Resolutions by comparison. Afterwards, the laws which includes the regulations of arbitration are emphasised in Turkish law. The third chapter of this study is titled as "Arbitration Process within The Rules of İstanbul Arbitration Center". This chapter mainly focuses on establishment process and purpose of İstanbul Arbitration Center and examines arbitration process and advantages according to the Rules of İstanbul Arbitration Center in detail.
