Disclaimer of inheritance

The subject of the study is disclaimer of inheritance. In this study, the provisions of civil law associated with disclaimer of inheritance are evaluated with opinions suggested in doctrine and supreme court decisions.In the first part of the thesis, the legal provision of the disclaimer term and disclaimer statement are described primarily and then virtual disclaimer and judicial disclaimer are analysed separately. Use of the right of virtual disclaimer are described and procedures in use of the right to disclaim are discussed in detail. After virtual disclaimer is examined, judicial disclaimer is examined. It is herein discussed that particularly judicial disclaimer will be in question under which conditions and the results to ensue in the event of judicial disclaimer.In the second part of the thesis, it is discussed the results of disclaimer of inheritance. Below this head, it is evaluated primarily that the disclaimer has an effect on lagator?s free disposition rate and the equalization obligation of inheritor who disclaims the inheritance. Thereafter disclaimer results and results of inheritor who disclaims inheritance with respect to legal and assigned inheritors are examined separately. It is also discussed the results associated with the fact that government that is herein legal inheritor disclaims inheritance.In the last part of the thesis, it is examined inheritor?s rights who disclaims inheritance and lagator?s rights to take in the event of being abusing of right to disclaim. In this scope, firstly it is discussed the conditions of action for nullity associated with disclaimer, the concerns associated withprocedure, and the results of action in detail.
