Abstract (EN)

Islamic law contains many different and long issues. It is very difficult for a muslim to know all these things and to keep them in memory. At this point, the idea that issues are based on the fundamental principles saves us. The source of these basic principles is consisted of sometimes the Qur'an, God's Word, sometimes Hadith-i Sharif, sometimes ijtihad of the mujtahids. These basic principles are called the legal maxims (general law rules) and dâbît (private law rules). If the legal maxims and dâbits are known, it is possible to get rid of drowning in very deep issues and at the same time it is possible to attain a thought structure. The way of learning legal maxims and dâbits is to apply to independent books which are related to them or apply fıqh books which express pratically. One of the most important of the fiqh books in which the legal maxims and dâbits are practically applied is the Düreru'l-Hukkâm fî Şerhi Gureri'l-Ahkâm, which was written during the ascension period of the Ottoman state and was taught as a legal book in medresses for centuries and used as a legal source in the courts. It is even more important that Molla Husrev's, who has the compliment of Fatih Sultan Mehmet "Abu Hanîfes of our time" wrote it. In this study, the provisions in Molla Husrev's work named Düreru'l-Hukkâm will be analyzed and will be identified of the legal maxims and the dâbits. It will be tried to reveal the purpose and the methods of author's using legal maxims and dâbits.
