Abstract (EN)
The years, that the only institution authorized to carry out the zoning activities was municipalities; in order to prevent problems such as illegal construction, speculation and to ensure the planned development; as an interim solution, the concept of adjacent area was to put forward outside municipal boundaries. According to the Zoning Law No. 45 of 3194 article, boundaries of adjacent areas approved by the Ministry of Public Works and Settlement.Today, in terms of legislation, taking into account the presence of different central government institutions responsible for urban development plans and law authorizes the central government institutions to make plan; it is thought that legal need of the concept of adjacent area should be terminated. Adjacent areas, has provided significant benefits for the purposes of the first years of their built up. However, recently the concept strayed from the purpose and began to be used for different purposes.In recent years, considering the applications of adjacent area, there is a high demand especially in high- rent areas, coastal areas and the fastest growing settlement areas.In this study, after intruducing historical development of the adjacent areas, practices were explicated in terms of building regulations. Explication method was carried out by using two techniques. Using In-depth interview method, the set of key concepts about adjacent areas, such as "Is it useful?", "Is it proportionate to the power of municipalities to serve them? and "should it be placed in our laws?" were clarified. A questionnaire survey was conducted for the ?sampled? municipalities, to describe the present situation.According to the results of this examine, it was determined the reasons for not being able to serve the purpose of adjacent areas for their appearence. And some suggestions were made to resolve the disadvantages experienced in practice. However, in terms of planning, negative affects of this concept is much more than positive ones. Therefore this concept should be removed for our laws.
