Unemployment insurance in comparative law and Turkish Law

With the enactment of Unemployment Insurance Law, Law # 4447,Turkey has encountered the application of unemployment insurance first timein its history. Throughout 6 years of its application, with the only change ofdecline in the contribution rates, the insured unemployed rate has reached to0,4 % of the total employment market. When we look into internationalapplications, however, we notice that the scopes of the application are quitecomprehensive.France and the United States, being belong to two different legal systems,has different understandings of social security. The history of the application ofunemployment insurance (or similar programs) in these counties aged morethan a century. French legal system is a part of a civil law (continental europeanlaw) system like Turkish legal system and it is a leading one. The legislation oflabor and employment issues in France carry a lot of similarity with Turkey.Seeing that there is not any comprehensive academic research or analysis onunemployment insurance in France, it will be usefull to do such a work.The academic works carried out in Turkey are usually based onEuropean systems. The legislation of the United States in this scope has beenpaid little attention, though it has a really important place in employment andlabor history. The application of unemployment compensation in United Stateshad also very important impacts for many European countries. A research andanalysis of legislation of a country, that is quite different from Turkey, will helpTurkey?s application to acquire a new perspective.Therefore, in the context of this thesis, after giving definitive informationof unemployment and unemployment insurace, the unemployment insurancelegislation of the United States, France and Turkey has been analysed in detail.As a result, with the comparative analysis, new proposals have been developedfor Turkey.Key Words : 1) Unemployment, 2) Unemployment Insurance3) Comperative Law 4) United States, 5) France, 6) Turkey,7) Law number 4447,
