These operations are not covered by law in Swiss ant Turkish laws; the problems related to the legal nature of the operation, the validity and the parties? rights are controversial and resolved in the light of the doctrine and the jurisprudence. Despite the lack of any legislation, these operations have a distinctive practice and the Turkish Supreme Court have a rich jurisprudence on the subject.
