Abstract (EN)

The problem of human beings to leave the places they live due to the fear of pressure and oppression and to try to find new living spaces is old as the history of humanity. Any permanent and satisfactory solution has been found to this problem. Protection of right to live, which is the most basic human right, is one of the fundamental principles of universal law. However, governments could not have shown sufficient sensibility because of their internal and external political concerns. The right of asylum arranged in the 14th article of Universal Declaration of Human Rights is tightly coupled with the right to live. Within this context, the right of asylum continued to be a right used for protection of right to live. In our study, we will emphasize refugees trying to protect their all rights initially the right to live.In the first part of our study, primarily the history of refugees will be mentioned briefly. After that, brief information about refugee movements in Turkish history, the period of League of Nations, the period of United Nations, and United Nations Refugees High Commissariat will be given and our main subject, Geneva Agreement in 1951 related to Legal Status of Refugees and the Protocol in 1967 in respect of Legal Status of Refugees will be tried to be explained as a summary in this part of study. In addition, regional agreements and regulations placed in Turkish Legislation and Turkish Judicial Decisions regarding to the subject will be mentioned in the first part.In the second part of our study, the Agreement of 1951 will be examined in details. The issues of conditions to be a refugee, reasons preventing the refugee status, and expiring of refugee status will be analysed here.In the last part of the study, procedures to be applied in order to determine the refugee status identified by United Nations Refugees High Commissariat will be emphasized.In the conclusion part, suggestions to solve the problems that refugees have both in our country and in the world and not to experience again the same tragic events in the history and also tasks assigned to us will be mentioned.Key Words1-Refugees,2-Asylum Seekers,3-Forced Migration,4-Non- Refloulement,5-Right of Asylum
