Collusion of legator

The subject of our thesis is the collusion of legator which is the most common type of collusion in teaching and practice. Although the legator's fictitious transaction occurs a lot in practice, also there is no legal regulation. In that case different opinions emerge in the doctrine in cases that are peculiar to the legator collusion. Our thesis focus on the collusion of legator which has been examined by including different views in the doctrine. Our study is consisting of three parts. In the first part of thesis, first of all; the concept of collusion, its definition, its elements, comparison with similar legal relations and the results of collusion are explained in order to better understand the subject. In the second part, definition of the legator collusion, the reasons that lead the legator to the collusion, the elements, provisions and results of the legator collusion and the claims about the case that is the subject of the legator collusion. Lastly, in the third part, the legal rights of the heirs against the fictitious transaction of the legator are tried to be explained.
