An evaluation of Mustafa Hayrullah's work named Tabâbet-i Adliye-i Mecânîn from a fiqh perspective

This study aims to evaluate the work Tabâbet-i Adliye-i Mecânîn of Mustafa Hayrullah Diker from a fiqh perspective, who lived in the last period of the Ottoman Empire and the Republic Period. The study consists of an introduction and two other parts. In the introduction, the subject, purpose, method and limits of the thesis have been mentioned. In this context, brief information about forensic medicine and forensic psychiatry have been given generally. The first part is the research part of the study. In this part Mustafa Hayrullah's life, the works he has been written with his character and ideas have been examined and information about some of the works he has been written have been given. After that, an evaluation of this work from a fiqh perspective have been made. The evaluations in question have been made within the framework of the sections determined by the author. Here, firstly, general information about the concerning part of the work have been given. Then it have been considered how the issue were treated in the İslamic literature and especially in contemporary studies. Lastly, it have been tried to evaluate Mustafa Hayrullah's ideas from this frame. At the end of this section, there is a general evaluation under the conclusion title. The third part consists of the transfer of the work to modern Turkish alphabet. Indeed the work Tababeti Adliye-i Mecânîn has been written in Ottoman Turkish. During the transfer it has been latinized with the free method. In order to allow easier comparison with the original script, the page numbers were given in the text.
