Abstract (EN)
Main goal of criminal procedure is reaching material fact by evidence. Although prosecutor and court have a range of power, can force suspect and defendant to prove they are guilty, this power isn't unlimited. In this context, one of the most fundamental right of defence for suspect and defendant is the nemo tenetur principle. Methods of obtaining evidence from human body have improved significantly as a result of recent technological development. At this point, the purpose of our thesis is to explain the nemo tenetur principle while establishing the legal conditions of the methods of gathering evidence through physical body examination and taking of body samples.
