Abstract (EN)
Betrothal, constituting a distinct and legally recognized contract within the ambit of family law, is governed by Articles 118 to 123 of the Turkish Civil Code No. 4721. This contract is specifically addressed within the "Marriage" section of the "Marriage Law" chapter, which comprises the first part of the Family Law book within the Turkish Civil Code. The act of entering into a betrothal agreement gives rise to legally enforceable rights and obligations for both contracting parties. In situations where the betrothal is dissolved, legal provisions allow for parties to pursue remedies, including claims for both pecuniary and non-pecuniary damages. With this study; the concept and scope of engagement and betrothal, the termination of engagement and compensation and legal consequences arising from its termination are dicussed. The research undertaken has identified numerous legal issues arising from the termination of betrothal contracts. These legal challenges are analyzed in detail within this study, drawing upon scholarly opinions and judicial precedents.
