Abstract (EN)

Qualified sexual assault committed by inserting an organ or other object is a crime that violates the sexual freedom of the victim and causes serious damage to the victim's personality due to its physical and psychological effects. The crime is often committed behind closed doors and its effects on the victim create difficulties in terms of proof. The difficulty in proving the crime of qualified sexual assault often causes the crime to go unpunished. The subject of the study is to examine the evidence in the crime of qualified sexual assault by creating the conceptual framework of the crime of sexual assault and proof and evidence. In this context, it is aimed to identify the reasons that create difficulties in terms of proof in the crime of qualified sexual assault, to evaluate the proof of the crime by taking into account the doctrine and court decisions, and to produce suggestions to eliminate the reasons that create difficulties in terms of proof.
