Olağanüstü Hal Kavramı Ve Denetimi

ÖZ: Bu çalışmada kavram olarak Olağanüstü Hal'in (State of Emergency) tanımı, uygulaması ve kapsamının ne olduğu, farklı siyasal ve hukuki anlayışlar çerçevesinde olağanüstü hal tanımları ve uygulamaları üzerinde durulmaktadır. Devletlerin bu kavrama ilişkin olarak yaptıkları anayasal ve yasal düzenlemeler, mevcut olan olağanüstü halin bizzat devlet tarafından devlet iktidarının güçlendirilmesi amacıyla kasten sürdürülmesi veya devletin iktidar olanaklarını genişletmek adına bizzat olağanüstü hali yaratma eğilimi ve bunun dünya tarihindeki örnekleri incelenmektedir. Hukuk devleti ilkesi üzerine kurulan hukuk düzeninin, olağanüstü hal konusunda bizzat devlet tarafından ortaya çıkabilecek suistimallere ilişkin kendini nasıl müdafaa edeceği ve bu durumlarda ne tür hukuki mekanizmaların işletilebileceği bu çalıĢmanın konusudur. Anahtar Kelimeler: Olağanüstü Hal, Hukuk Devleti. …………………………………………………………………………………………………………………………… ABSTRACT: This thesis sets out to investigate the concept of “The State of Emergency”, the research focuses on the notion‟s definition, application and to what extent it is used. The definition of the notion within different political and judicial contexts is investigated by analyzing the decision making processes of different governments on their legal and constitutional arrangements according to the concept. The deliberate maintenance and/or creation of the State of Emergency by the government in order to strengthen and expand its political power is an important research subject of this thesis and is further investigated by looking into examples of this 'empowering strategy' in world history. The principle of Constitutional State, its operation and protection in case of a State of Emergency that is deliberately abused by the governing body and the types of legal regulations that can be done in such cases is another important research focus of this thesis. The conclusive evidence and examples investigated throughout this thesis demonstrates how extensive and abusive the concept of State of Emergency is used by world governments.
