Abstract (EN)
Le Code Civil parle des quatres types de vices de consentement: ce sont l?erreur, le dol, la menace et la violence. La législateur a détérminé que la sanction des vices de consentement est la caducité partielle. Au cas de la caducité partielle on doit examiner les effets en deux parties. Ces deux parties se séparent par le décès du défunt. Avant le décès du défunt, la faculté de révoquer le disposition avec tous les effets est au défunt. Le défunt a l?opportunité de révoquer son disposition pour une année aprés qu?il est informé de l?erreur et du dol ou aprés l?influence de la menace et la violence. Si le défunt ne révoque pas son disposition dans les limites de cette durée alors le disposition devient sain. Après le décés du défunt, les héritiers doivent demander l?annulation du disposition annulable. La législateur a determiné des différents délais de déchéance, 1 et 10 ans contre les héritiers à bonne fois et 20 ans contre les héritiers à mauvaise fois. La décision de nullité se pose ses effets seulement sur les partis de l?action, c?est une décision relative. On ne peut pas demander la délivrance des choses léguées en supportant la décision de nullité. Pour demander la délivrance des mobiles ou l?immatriculation des immobiles on doit demander un action en revendication.There may be numerous causes to prevent the coming into force of a testamentary disposition and invalidism of willpower is only a division in the study of these causes. In Turkish Civil Code, there exist four types of invalidism of willpower on testamentary dispositions, which are fault, fraud, duress and forcing. There are two different types of nullity, which are absolute nullity and voidability. For cases that involve absolute nullity, it has to be identified. In case of voidability, the consequences would be analyzed in two aspects depending on the death of the devisor. Legislator allows a period of one year for the divisor to revoke his/her testamentary disposition starting from the appearance of the fault and/or fraud or the desertion of the effects of forcing and/or duress. In case of a lack of revoke statement during this one-year period, the testamentary disposition will be recovered. Following the death of the devisor, a suit of nullity would be required in order for the heir(s) to annul a voidable testamentary disposition. The defined timelines to open a suit of nullity are determined as 1 or 10 years against good-faith heir(s) and 20 years against bad-faith heir(s). An annulment is a relative verdict that is binding for only the related parties of the lawsuit. The defendant could not be required to return the inheritance directly by an annulment verdict. It?s necessary to plead for getting back the assets to the estate.
