The ombudsman (public inspectorship)

Ombudsman is an institution, whose prototype was generated in Sweden in 18th century and which is in practice in over one hundred countries. Ombudsman is an institution which is constituted by constitution or law, governed by an independent and high-ranking official, investigates upon the complaints made by suffered against the public institutions and their officers or on his own motion and has the authority of inspection, reporting and recommend corrective actions. Turkey was not very aspirant in building up an Ombudman institution. For all those discussions started by academic since 1970s, the institution which could not be copromised upon, could narrowly be constituted, after a few attemps in enactment, with the Law no. 6328 in 2012. In this study, it is aimed to present, within the frame of its legal regulation, how much the Public Inspectorship could be successful in being accepted as an effective inspection mechanism. As a result of this study, taking into consideration of the ombudsman practices in different countries, but foremost the mother country Sweden Parliamentary Ombudsman, it is determined that the legal regulation of the Institution is not sufficient in regulating the Institution as an effective inspection method.
