Abstract (EN)
Collusion in the amount in pre-emption cases are usually arises as stating high prices of the sale made in order to prevent the use of pre-emption right of the right holder. Collusion in the amount claim that mostly alleged in pre-emption cases can be proven by any kind of evidence, even with witness in the presence of certain conditions. In our study; pre-emption right, pre-emption case and demonstration with witness of claims of collusion in the amount in pre-emption cases are studied in detail accompanied with Turkish Court of Cassation decisions.
