Abstract (EN)
The hotel allotment agreement is a contract specific to tourism law. It is a special type of contract between travel agencies (accommodator) and hoteliers (host), which is referred to as hotel contracts both in practice and in international texts. Hotel allotment agreements that do not have a legal regulation. In practice, these agreements are also named as "allotment (quota) agreements" or "full for empty contracts". In hotel allotment agreements, hoteliers undertake to reserve a place before the start of the tourism season, to provide accommodation services to the sent guests (customers), and to pay sales profit or commission. Travel agencies generally undertake to collect the accommodation costs and pay the hotelier, to make an effort to provide customers, and to pay the accommodation fee as compensation, even if the customer does not come after the reservation (no-show) if a guarantee is given. All details regarding the individual accommodation agreements to be made within the contractual relationship are determined in advance by the hotel allotment agreement. In our study; all processes from its establishment to its termination and its results were examined by considering the doctrine, judicial decisions and procedural law provisions and practice. The examples of contracts used in practice were included at the end of the study.
