Abstract (EN)

In today's world, immaterial goods can have much more value than the movable and immovables which constitutes the subject of classical property is the patent right. The patent right, which is also a type of property right, is an element of social life and interacts with society. This state of interaction makes it impossible to make unlimited use of the patent right due to the requirements of the patent system, the requirements of the society and economic order and the purposes of the patent system, as it is about property. In this context, the patent right has both temporal and geographical boundaries and at the same time it is an intellectual property right registered with numerous exceptions for the purposes of public interest, public health and economic growth. In our study, the historical and intellectual evolution of these limitations, the reasons and the scope of these exceptions and limitations are examined.
