Abstract (EN)

Artificial intelligence is among the most popular topics, today. It is controversial by which legal institution artificial intelligence, which has an important place in the development of technology and its reaching today's level, should be protected. Various opinions are claimed, including unfair competition, protection within the scope of Intellectual and Artistic Works Law, and protection by patent law. In this study, an examination is made on the place of artificial intelligence in patent law. Patent law has an incentive function in terms of creating new inventions, it also enables the transfer of technology to different countries, continents and even to new generations, in other words, the transfer of technology. Along with all these, patents also have an impact on the economy. Patent law dealing with inventions should be up-to-date, because technology has a dynamic structure and can change over time. In this context, issues such as whether artificial intelligence is accepted as an invention, which conditions it must meet in order to be patented if it is accepted as an invention, and the place of inventions created by artificial intelligence in patent law should be resolved.
