Abstract (EN)

Rafi al-Kazvini is a Shafi'i scholar who was born in the lands of today's Iran and had been called as Aleemu'l-'acam wa'l-Arab in history. The title of "Shayhan" was given by sectarian scholars because he collected the scattered opinions in the sect and played an important role in determining the opinion of the sect by separating the authentic and the saz views from each other. Rafi copyrighted a lot of works. No doubt that one of the most impartant ones in these works is Fathu'l Aziz which is his interpretation work about Ghazali's Al-Wacez. The fact that he conveyed the Shafi'i Sect's views and stated the weak and authentic opinions, conveyed the opinions of the imams of different sects and discussed the evidences, added the atmosphere of a comparative fiqh book. In his work called Fethu'l-aziz, Râfiî especially compared Ebu Hanife more than other imams. Our study consists of introduction, three bodies and conclusion. Information about the importance, content and method of our research was given in the introduction. In the first part, the life of Rafi al-Kazvini, his position in the sect, especially Fethu'l-aziz and his other works, were introduced. In the second part, some information about İslâmic Criminal Law, the basis for our readers to understand better the third part(the main topic) of our thesis, was given. In the third part, the views compared to Ebu Hanife in Fethu'l-aziz, which is the main topic of our thesis, were determined and analyzed. In the conclusion, we gave information about our study and presented the results we reached as a data for the benefit of our readers.
