Abstract (EN)
European Union has performed efforts on behalf of the establisment of a common market within the union since 1950. In this context, every states who wants to be a member and the members have begun to regulate their legislations. An easy applicable, intellectual rights system must be created for the development of small and medium sized enterprises in the most economical manner. The necessity of each system is intended to create its own know-how. Therefore, systems such as franchising and contracts, they might form, are needed for small and medium sized enterprises. By courtesy of these systems and contracts, enterprises contribute to development of the market as well as have a financial strength. But with all these undertakings, when performing such activities, should not obscure the activities of other enterprises which are outside of the system and their activities. Enterprises should carry out its activities according to competition policy of Eurepean Union and of country where activities takes place.Evaluation of the Franchise agreement, in terms of competition law is this thesis? topic. But first it must be said, the franchising agreements will be evaluated only in terms of law.First, definitions of franchising and the Franchise agreement, law, obligations of the parties, relationship with similar contracts, advantages and disadvantages will be tried to explain. And then, Franchise agreements will be examined in terms of competition law. Within the framework of the Turkish Competition Law No. 2002 / 2 Block Exemption Communiqué on Vertical Agreements will be discussed. Lastly, reasons for termination of Franchise agreements will be stated.
