Abstract (EN)

The concept of ''Liability arising from robotic surgical interventions'' has gained great importance today. Because both law and medical science are in a great change and development. At this point, surgical interventions have gained new applications. And new applications brought some changes. These changes are of interest to both law and medicine. The aim of this study is to examine the situations that may occur as a result of robotic surgical applications and to perform the legal analysis. In the first part of the study, the concepts related to the subject are explained and various elements are mentioned. These concepts are related to both medicine and law. Through mentioning these concepts and elements, it is aimed to better understand the subject. Since robotic surgery system is essentially a method of surgical intervention, the concept of medical intervention and its elements are discussed in detail. In the second part of the study, the place of robots in the health sector and robotic surgery applications are given. The role of robots in the health sector has been examined, and the positive and negative aspects of robotic surgery applications have been mentioned. In the third chapter, the legal liability that may arise from the robotic surgical intervention is examined. It has been processed to whom, what type of responsibilities and under what conditions can be assigned. Elements and conditions of concepts such as contractual liability, non-contractual liability, tort liability, statute of limitations are explained.
