The institution of subcontracting in Royalty (Redevance) Aggrement and the principles of civil liability in this regard

The subject, of the thesis is royalty contract that a person who has mining resarch and operating licence have mining activities done by means of private person or legal entity and in return for this gets rental fee. Natural persons or legal entities who have licence want to hand on their operating rights for a wide range of reasons. Those who have licence want to transfer their rights to third parties both as result of the lack in terms of operating alone in a very large area and sometimes due to financial woes. In thesis, royalty contract and equavialent of the related one in labor law were explained. This subject was preferred to study as a consequence of this topic had been studied few before. At the first part of the study royalty contract was examined in general. At the second part of our study, relationship between subcontracting and royalty contract. Under this subject title, subcontracting relations, the parties of this relations and elements of the related subject were also examined. After that, the institution of subcontracting in royalty contract was studied. The matter of whether royalty contract would give rise to subcontracting relationship. At the third part our study in case of royalty contract bring about to subcontracting relation, the issue of civil liability that spring up from employership relation was examined and the study was completed.
