A model proposal for the legal aspect of integration of urban archaeological assets into the city: samsun saathane square

After World War II, archaeological remains in European cities provided the emergence of the concept of urban archeology. Urban archeology refers to archeological sites within the city. The preservation of archeological sites in cities that have been inhabited since prehistoric times, gained importance over time, and the conservation approach in this area has developed. Despite the development of the approach, the lack of significant development in the consciousness of the people has made the preservation of urban archaeological assets dependent on legal regulations. In this context, changes in legal regulations are directly related to conservation approaches of urban archeological assets. Protecting archaeological sites in urban areas according to conservation and exhibition principles creates problems in cities that are living organisms. Different solutions are sought to solve these problems in recent years. In Europe, strategies to integrate urban archaeological sites into urban areas are being developed through conservation and utilization studies, and archaeological sites are protected and transformed into living spaces. The aim of this thesis is to create legal regulations that will enable the transformation of urban archeological assets into living spaces in Turkey. In this context, legal arrangements were examined according to international legislation and legal regulations of exemplary countries and constraints in implementation phase were examined in Samsun Saathane Square excavations. The outcome of this study is to determine the deficiencies in the legal system and to develop a managerial model proposal for these deficiencies by determining the appropriateness of the application decisions with scientific studies and international protection legislation.
