Abstract (EN)

This Ph.D. dissertation aims to answer the question: "How should the right to access to art be fulfilled by the administrative agencies?" The state involvement in art activities is a historical phenomenon and thus, it is necessary to examine this issue within the context of fundamental rights and from the perspective of administrative law. Accordingly, the dissertation focuses on two fundamental questions (1) is there a right to access to art, and (2) what are the art activities of the administrative agencies. The first chapter, titled "Access to Art," initially discusses the concept of art and the relationship between the state and art. It then evaluates whether a right to access to art exists within the framework of the Constitution of the Republic of Türkiye and relevant international treaties. The second chapter, titled "Art Activities of the Administrative Agencies," first examines the administrative agencies authorized and responsible for conducting art activities. It then evaluates the art activities performed by these agencies. In this context, the study addresses two main activities: the provision of art activities as a public service and the support of art through state aid/subsidies. The dissertation also covers art education as an activity supporting access to art. This study adopts a doctrinal research method, engages in theoretical discussions, and includes a detailed analysis of legislation and administrative activity reports to identify the intentions of both the legislature and administrative agencies. Additionally, the dissertation draws on the legal systems of France and the United States, which are considered to offer differing approaches to the states' role in the field of art.
