Determination of branch of activity in the unionism

Although unionization is not explicitly prohibited on the basis of workplace and occupation in the Act No. 6356 on Trade Unions and Collective Agreements, the establishment of unions on the branch of activity of work has been adopted and collective bargaining has been shaped according to this principle. Determining the line of business a workplace is involved in; Establishment of unions, union membership, field of activity of unions, level of collective bargaining agreement, types of collective bargaining agreement, authority to collective bargaining directly affect and are of great importance in terms of these issues. For this reason, it can be said that the concept of branch of activity is the backbone of the Turkish collective labor law system. In our study, determining the branch of activity in which a workplace is included is of such importance in Turkish collective labor law, so it is of priority; the subjects of the legislation on the business line, the name and number of the lines of business are determined and how the works included in the lines of business are determined. In particular, NACE Rev.2-Six Economic Activity Classification has been discussed in terms of our country due to the status of the classification in terms of European Union countries and its role in determining the jobs included in the branch of activities. In addition, the concept of workplace and the boundaries of the workplace were also examined due to the importance of the correct definition and determination of the concept of workplace, since the workplace as a unit is taken as a basis in determining the branch of activity. In our study, due to its effect and importance on the current regulations, the regulations in the abolished laws were sometimes given, and on controversial issues, the doctrinal views and Supreme Court decisions were also mentioned.
