Abstract (EN)

In this study the life of Ebü'l Hasan Ali Muhammed el-Isbîcâbî, who lived in the 6th century according to Hijri calendar and who was one of the six jurists belonging to the Hanafi sect and bearing the title of Sheikh al-Islam and his fiqh views are discussed. The aim of this study is to mirror Isbîcâbî's scientific life, his perception of fiqh and contribution to the Hanafi jurisprudence as a man of having an important place in the Hanafi school to become a judge in an important science centre like Samarkand and to be received the rank of shaikhalislâm. This study consists of three parts. In the first part, Isbîcâbî's life was examined within the framework of literature research. The political life of the states that ruled in the region where Isbîcâbî grew up, the developments that took place in this context and the importance these states gave to the scientific life were discussed. In the second part, Isbîcâbî's perception of fiqh is discussed with the main lines. His work called Şerhu Muhtasari't-Tahâvî has been examined as an example and what kind of a work it is has been revealed within the framework of the writing style of this work and the sources and examples he used. In the third chapter, Isbîcâbî's contribution to Hanafi fiqh in the field of substantive fiqh was examined and the successor scholars' referring to the views of the Jurist and using these views as a reference source in their own work were discussed specifically at the point of worship. As a result, Isbîcâbî's genuine personality and scientific background were revealed with this study.
