Abstract (EN)
This paper is a study about how the istihsan method is applied in Muhammad al-Shaybani's book "Al-Asl". The mentioned book is important because it is one of the main fiqh sources of the Hanafi Sect. The study consists of three parts. In the first part, the biography of Imam Muhammed and the introduction of his work Al-Asl, used as base of our study, are given. In the second part, general information about the istihsan method in Islamic law is given. In the third chapter, examples of istihsan in the Al-Asl of Al-Shaybani are given.
