Cyber terrorism has entered our lives with hybrid warfare methods used alongside conventional warfare in the last century. As a result of the transfer of interstate wars to the cyber environment with technological developments, cyber attacks on critical infrastructure, critical facilities and assets, production facilities and energy infrastructures of states have increased, creating a new global power struggle in cyberspace. Non-state actors and terrorist organisations have identified cyber-terrorism as an effective social tool to achieve political goals through the use of Internet technologies. It has become possible for states to inflict damage at lower cost on the critical infrastructure of other states that they perceive as rivals. In this context, the question of compensation for the material and moral damage suffered by individuals as a result of terrorism, simply because they are citizens of that state, has come to the fore, under the responsibility of the administration. On the other hand, as in any international law, it can be seen that the regulations regarding the compensation of damages resulting from classical terrorism and the fight against terrorism in Turkish law are not sufficient for the damages that citizens may suffer as a result of cyber attacks, and there is a legal gap in this area. In this study, the main elements of cyber terrorism within its historical development, cyber attack methods used as tools in cyber terrorism, cyber security measures for the cyber resilience of states and proposed solutions that will guide the legislator to fill the legal gap in this area are discussed.
