Clarification liability of the insurer in insurance contract

Abstract (EN)

In insurance contracts, the insurer's obligation to enlighten is regulated in Article 1423 of the Turkish Commercial Code No. 6102 to cover all types of insurance. In the first part of our study, the importance of insurance institution is going to be emphasized in the context of Insurance Law in general. The next section examines the rights and obligations of the parties to the insurance contract. Finally, in the third chapter, information about the subject, content and legal nature of the obligation of illumination will be discussed. In the meantime, regarding to "culpa in contrahando" and the insurer's obligation to enlighten is going to be considered and the form and the sanctions of the liability will form the framework of our thesis. The clarification liability, defined as charge in the code, the aim of explaining the purpose of the introduction will be discussed and the importance of its will be tried to be emphasized.
